David M. Peraino | Founding Partner
David Peraino is a founding partner of Peraino Malinowski LLP and a trusted strategic advisor to many of New York’s most prominent developers, property owners, and design professionals. He is widely recognized for delivering sophisticated legal solutions across high-value transactions and complex commercial disputes in the New York City market.
David has negotiated and drafted design and construction agreements with a combined value exceeding $5 billion, advising on some of the most complex and high-profile development projects in the region. His deep experience in large-scale urban construction allows him to identify, structure, and mitigate risk at the earliest stages of a transaction, ensuring that each agreement protects financial exposure while preserving long-term project viability.
A seasoned litigator, David represents clients at every level of the New York State court system in high-stakes commercial disputes, including breach of contract, professional liability, and insurance coverage matters. He is a formidable advocate in trial courts, appellate divisions, and alternative dispute resolution forums, known for delivering efficient, business-focused outcomes, particularly in multi-party and technically complex cases.
David is also widely regarded as a leading authority in RPAPL 881 proceedings, a specialized area of New York real estate and construction law. He has secured precedent-setting decisions at both the trial and appellate levels, representing developers seeking access and adjacent property owners protecting their rights. His ability to navigate access agreements and neighbor disputes with precision allows projects to move forward while minimizing legal friction in densely built environments.
Prior to co-founding Peraino Malinowski LLP, David was a partner at a leading New York construction law firm. He earned his Juris Doctor, magna cum laude, from Brooklyn Law School and his Bachelor’s degree, magna cum laude, from Providence College.
